PRE-LAUNCH DRAFT — not effective. Version 1.2 · Prepared 4 November 2026. Effective date: [EFFECTIVE_DATE]. Complete all placeholders and implement the described commercial features before publication.
1. Who provides Weast
Weast is provided by [PUBLISHER_LEGAL_NAME], an individual established in Poland, at [POSTAL_ADDRESS] (“we”, “us”). Contact: [SUPPORT_EMAIL]. Website: [WEBSITE_URL]. Any legally required registration or tax identification details: [APPLICABLE_REGISTRATION_DETAILS].
These Terms govern your use of the Weast application and the licence we grant. Paid purchases are sold by the Paddle entity identified at checkout, acting as authorised reseller and merchant of record. Paddle’s Buyer Terms govern that purchase transaction. Our Refund Policy supplements those terms without reducing your rights. Our Privacy Policy explains data handling.
Mandatory law prevails over any conflicting provision. Where an additional refund commitment gives you greater protection, it remains available.
2. What Weast does
Weast is a macOS application for viewing and presenting your own media with geographic context. Available features may include maps, GPX routes, terrain, buildings, recorded camera direction and weather information. The current Free/Pro feature list, price and supported system requirements are disclosed at [PRODUCT_AND_REQUIREMENTS_URL] before purchase. Supported macOS versions: [SUPPORTED_MACOS_VERSIONS].
Weast is a presentation tool. It is not a navigation, emergency, surveying or safety-critical service. Map, elevation, route, direction and weather information may be incomplete, approximate or outdated. Do not rely on it for safe travel, current weather decisions or determining legal access to land.
You must have legal capacity to enter the relevant agreement, or the legally required involvement of a parent or guardian. A person purchasing for an organisation must have authority to do so.
3. Your content
You retain ownership of your photos, videos, projects and GPX files. You are responsible for having the rights and permissions needed to display them, including in commercial presentations. We do not acquire ownership of your content.
Ordinary operation does not upload your original media to our servers. Online map and weather functions nevertheless transmit requests that can disclose locations or viewing areas, as described in the Privacy Policy. Keep independent backups; Weast is not a backup service.
4. Licence: one Mac, multiple users
Subject to these Terms, we grant a limited, non-exclusive licence to use Weast. Free features and the trial may be used for personal, non-commercial purposes. Commercial use requires an active paid Pro subscription, including use for clients, a business or professional presentations. A paid licence key may be activated on one Mac only. Multiple people and macOS user profiles may use that licensed Mac, including staff in a studio or business with an active paid Pro subscription. This does not permit simultaneous activation on other Macs.
You may reinstall and reactivate on the same Mac. A paid licence cannot be transferred to a different Mac, including after sale, loss or replacement of the original hardware. A different Mac requires its own licence. Mandatory remedies for faulty or non-conforming services remain unaffected.
You may not resell licence keys, bypass access controls, distribute unauthorised copies or use the service unlawfully. Restrictions on reverse engineering apply only to the extent permitted by law and do not restrict statutory interoperability rights. Third-party software and map data remain subject to their own licences and attribution requirements.
5. Free version and 14-day trial
You may use the Free features without buying Pro. A trial with Pro features lasts 14 consecutive days from your first activation of Pro, once per device, subject to the non-commercial-use restriction in section 4. The trial does not require a payment card or email address and does not automatically create a paid subscription. A minimal device activation record is used to enforce the one-trial limit; reinstalling does not restart it.
When the trial ends, Pro features become unavailable. Your original media, projects and added routes are not deleted. Purchasing Pro requires a separate, explicit checkout.
6. Paid subscriptions
Pro is offered as monthly or yearly subscriptions. The checkout states the amount, currency, tax treatment, billing interval and renewal terms before you pay. A subscription automatically renews for the stated interval until cancelled. There is no Weast account requirement, but Paddle needs purchase and billing details, including an email address. Your licence key controls activation.
To stop future renewals in Weast, open Settings → Subscription and cancel your subscription. If you cannot access the app or need assistance, contact [SUPPORT_EMAIL]. Paddle also provides cancellation through its purchase-management links and purchase support, under its own terms. Cancellation takes effect at the end of the paid period; Pro remains available until then, unless a refund or another lawful termination ends the entitlement earlier. Cancellation alone does not normally create a proportional refund. Our Refund Policy and mandatory rights continue to apply.
Except for the Founders Price commitment below, any price change applies prospectively with the notice and cancellation opportunity required by applicable law and Paddle’s terms. No new price is charged retroactively for a paid period.
6.1. Founders Price
Founders Price is a promotional yearly Pro subscription at $84 per year, equivalent to $7 per month and billed annually, rather than the standard annual price of $108. Applicable taxes may be added at checkout. The offer is limited to our first 100 customers and is available until December 31, 2026, or until those places are taken, whichever occurs first. The checkout must identify the Founders Price offer before you pay.
The subscription renews automatically every year at $84 until cancelled. This subscription price is locked for as long as the same subscription remains continuously active; applicable taxes may change. If you cancel and later take out a new subscription, the standard annual price shown before the new purchase applies (currently $108 per year). The Founders Price does not transfer to a new subscription. Cancelling future renewals leaves access available through the period already paid for, subject to refunds and other lawful termination.
The same first-purchase refund guarantee and statutory rights described in section 12 apply to Founders Price purchases. The promotion does not create an additional refund period for renewals or later purchases.
7. Internet and access checks
An internet connection is required to start a new presentation and validate access. Maps, weather and other remote features also depend on external services. If connectivity is lost during an already-open presentation, that presentation may continue using available loaded or cached functionality until you close it. Missing tiles, fresh weather and other unavailable remote data are not guaranteed during an outage. A new presentation cannot be started offline.
After a subscription expires, Pro is blocked and Free remains available; local originals, projects and GPX files are retained. After a confirmed full refund of the transaction supporting your Pro entitlement, that entitlement ends immediately, including during an open presentation. The application enforces this as soon as it receives the updated status. A disconnected application cannot receive an instantaneous remote update; continuing a loaded session does not extend a refunded licence.
A correction of a duplicate charge does not invalidate a separately paid, valid entitlement.
8. Updates, availability and changes
We provide updates required by applicable law, including necessary security and conformity updates. You should install those updates within a reasonable time. We do not promise compatibility with every future macOS version or that every future feature will be included in your plan.
External data availability and service interruptions can affect features. Where changes to an ongoing digital service are legally permitted, valid reasons may include security, legal requirements, compatibility or a necessary replacement of an external provider. We will provide required information and notice. If a change materially and adversely affects your use, any statutory right to terminate or obtain another remedy remains available. These Terms do not permit arbitrary removal of paid rights without a remedy.
9. Support and complaints
Support is available by email at [SUPPORT_EMAIL]. There is no guaranteed response time, round-the-clock support or contractual service-level agreement. This does not limit legally required complaint-handling deadlines or remedies.
For a technical complaint, describe the issue, your macOS and Weast versions, and any relevant purchase reference. Do not send original private media unless you choose to do so after discussing a suitable method. Payment and refund requests may also be made through Paddle.
Consumers retain all applicable rights concerning conformity, supply, repair, price reduction, termination and refunds. These rights also apply to business purchasers where the law gives them equivalent protection. A trial, voluntary refund period or cancellation does not replace those rights.
10. Responsibility and suspension
We remain responsible to the extent required by applicable law. Nothing excludes liability that cannot lawfully be excluded, including for fraud, intentional wrongdoing or other protected claims. We do not guarantee the accuracy or continuous availability of third-party data, but this statement does not remove any mandatory obligation we owe concerning the supplied service.
We may suspend a licence for substantiated fraud, unlawful use or a material breach of these Terms. Where appropriate and lawful, we will explain the reason and give a reasonable opportunity to resolve the problem before suspension. You may contest an error through support. Suspension does not authorise deletion of your original files or remove statutory remedies.
11. Changes to these Terms and disputes
We may update these Terms for valid legal, security or operational reasons. We will give notice where required and will not retroactively remove accrued rights. Material changes to an existing paid agreement require the procedure and protections required by applicable law. The version applicable to your transaction will remain available on request.
Polish law governs our licence agreement, without depriving a consumer of mandatory protections of the law that would otherwise apply to them. You may bring claims before courts available under applicable jurisdiction rules; these Terms do not impose exclusive Polish jurisdiction on consumers. Paddle’s transaction contract has its own governing provisions.
Contact [SUPPORT_EMAIL] first if you wish to seek an informal solution. Doing so is not a condition for exercising legal rights or contacting a competent authority or court.
12. Refund Policy
This section forms part of these Terms and applies to Weast Pro purchases through Paddle.
12.1. Your rights come first
This policy adds a voluntary refund commitment. It does not limit statutory withdrawal rights, rights concerning faulty or non-conforming digital content/services, or any greater protection available under Paddle’s Refund Policy.
Statutory withdrawal and refund rights depend on your location, the type of transaction and the applicable conditions. For example, a 14-day withdrawal right may apply to the first payment under a subscription contract. Paddle’s policy also provides a separate 14-day withdrawal period for UK annual subscription renewals where applicable. Any lawful exception or loss of a withdrawal right depends on the required conditions being met; simply installing or opening Weast does not, by itself, establish that those conditions are satisfied. Our first-purchase-only guarantee does not restrict these separate rights.
12.2. First paid purchase: 14-day refund
You may request a full refund of your first paid Weast Pro transaction within 14 calendar days after that transaction, without giving a reason. This voluntary guarantee applies to consumers and business purchasers, and to monthly, yearly and Founders Price plans. It applies only to your first paid purchase, not to renewals, repeat purchases or a new subscription taken out after cancellation.
The 14-day, card-free trial is separate. Starting or completing it does not consume your voluntary refund period for your first paid transaction. Any additional or more favourable statutory or Paddle right remains available.
12.3. Renewals and cancellation
Renewals and later purchases are not covered by our voluntary first-purchase guarantee. Unless applicable law or Paddle’s applicable policy provides a right to a refund, they are non-refundable. Paddle may consider discretionary refund requests submitted within 14 days of a transaction, but submitting a request does not guarantee approval. Statutory rights, remedies for defects or billing errors, and any separate renewal withdrawal right remain unaffected.
You can cancel future renewals at any time in Settings → Subscription in Weast. The assistance and Paddle cancellation channels described in section 6 remain available. Cancellation normally leaves Pro available through the paid period and does not itself create a proportional refund for unused time.
12.4. Billing errors and technical problems
Contact us or Paddle about duplicate charges, an incorrect payment or a persistent material defect. These are assessed separately from the voluntary 14-day first-purchase guarantee. The applicable remedies may include correction, repair, a price reduction, termination or a refund, as required by law and the facts of the case.
Nothing requires you to accept technical troubleshooting instead of a remedy you are legally entitled to. Nor must you explain your reasons when exercising a no-reason withdrawal or our first-purchase guarantee.
12.5. How to request a refund or withdrawal
Use Paddle purchase support or email [SUPPORT_EMAIL]. Sending a timely request to either channel is sufficient for our voluntary 14-day first-purchase guarantee. Any statutory withdrawal methods provided by Paddle, including a withdrawal option in its Customer Portal for eligible transactions, also remain available. Include your purchase email, transaction reference if available, and whether you seek cancellation, a refund or statutory withdrawal. We may ask for reasonable information to identify the transaction; no particular form or wording is required.
You may use this optional notice:
To [PUBLISHER_LEGAL_NAME] / Paddle: I notify you that I withdraw from my purchase of Weast Pro, made on [PURCHASE_DATE]. My name is [NAME], my purchase email is [EMAIL], and the transaction reference is [REFERENCE, IF AVAILABLE]. Date: [DATE].
Refunds are processed through Paddle, normally to the original payment method. We do not ask you to send banking details to receive a separate direct reimbursement from us. Applicable legal deadlines govern eligible statutory refunds; payment-provider processing can affect when funds appear in your account. We will explain any information needed to process your request.
12.6. Effect on access and files
A confirmed full refund of the transaction supporting your Pro access ends that Pro entitlement immediately, including during an open presentation. The application blocks refunded Pro features as soon as it receives the updated status. A disconnected application cannot receive an immediate remote update; this delay does not create an entitlement to continued refunded Pro access.
Your original media, projects and added GPX files are not deleted. Free features remain available. Correcting a duplicate charge or another billing error does not cancel an independently valid paid entitlement. A refund is handled together with the appropriate subscription cancellation or adjustment so that the relevant refunded subscription is not unintentionally renewed.
